Terms and Conditions

These Terms of Use apply to visitors’ access to the Website and users’ use of the Service. The Terms of Use constitute an agreement between you and Colourful jobs. By visiting the Website, you agree to be bound by the Terms of Use.

Article 1 The Website and the Service

1. The user may request to post a job listing by submitting the application form. After the job listing is posted, the user will receive a confirmation and an invoice. The agreement is concluded after Colourful jobs has posted the job listing.
2. Colourful jobs the user, under the terms of the agreement and the terms of use, with the service as described in the agreement and the terms of use.
3. Colourful jobs the right to refuse to publish a job listing without explanation. Colourful jobs not liable for any damage suffered and/or to be suffered as a result. The user indemnifies Colourful jobs any claims for damages in that regard.
4. The user acknowledges and accepts that Colourful jobs provides a platform on which users and job seekers can be brought into contact with one another. Colourful jobs no knowledge of and/or involvement with the job posting information and other information made available by users through the website and/or service. Nor does Colourful jobs have Colourful jobs knowledge of and/or involvement with the content of job postings as posted by users on the website and/or service. If another user, a visitor, or a third party Colourful jobs unlawful job posting information to Colourful jobs and substantiates this claim, Colourful jobs will remove Colourful jobs relevant job posting information or the job posting. The user acknowledges and accepts that Colourful jobs is Colourful jobs liable for the removal of the relevant job posting information or the job posting.
5. Colourful jobs not responsible for any decision whatsoever made by users or visitors to the service. Colourful jobs therefore Colourful jobs no guarantee of success.

7. The user and the visitor are fully responsible and liable for all actions they perform using the website.
8. The user and the visitor accept that the website and the service contain only the functionalities and other features as they appear on the website at the time of use. Colourful jobs entitled at all times to modify the website and/or service, to (temporarily) suspend it, to restrict its use, and/or to terminate it, without being or becoming liable in any way for damages or otherwise liable to the user and the visitor. If the user and the visitor do not agree with the implemented adjustments and/or changes, they are free to discontinue use of the website and/or service.

Article 2
Submission Form
1. The user must submit the job posting for publication by completing and submitting the submission form. The user warrants that the information provided on the submission form is complete, up-to-date, truthful, and accurate.
2. The user may not submit a submission form in the name of another person or in the name of a fictitious person. Colourful jobs that the user is indeed the person submitting the application form.

Colourful jobs 3 Rules for the Use of the Website and the Service
1. The user is responsible for the accuracy and completeness of the information they provide, including job posting information and account information.
2. Users and visitors are not permitted to reproduce, disclose, resell, use for commercial purposes, or otherwise make available to third parties, or to use it to commit any other unlawful act, including but not limited to the collection or use of other users’ data to subsequently contact these users for purposes other than those for which the data is intended, such as for other work and/or other suitable candidates.
3. The user indemnifies Colourful jobs claims by third parties based on the assertion that the user’s use of the service, including but not limited to the posting of job vacancy information, is unlawful in any way.

Article 4 Payment and Price
1. The price for posting a job listing can be found on the website.
2. All listed prices are subject to change without prior notice. Price changes do not apply to services already purchased.
3. Payment by the user is made by transferring the invoice amount to the bank account specified on the invoice within 30 days of the invoice date.
4. If the user fails to meet their payment obligation(s) on time, Colourful Jobs will issue Colourful Jobs , and the user will have a period of 14 days to fulfill their payment obligations. If payment is not received within this 14-day period, statutory interest shall accrue on the amount due, and Colourful jobs shall be Colourful jobs charge all costs incurred and to be incurred as a result, expressly including all extrajudicial (collection) costs and all actual judicial costs, including but not limited to attorney’s fees. The extrajudicial (collection) costs will be calculated according to the extrajudicial collection costs scale (BIK), unless the actual extrajudicial (collection) costs incurred are higher. In the latter case, the actual extrajudicial (collection) costs incurred will be charged to the user.

Article 5 Job Posting Information
1. By posting job information, the user grants Colourful jobs royalty-free, worldwide, irrevocable, sublicensable, and transferable right to publish and reproduce such job information to the extent that this is reasonably necessary or desirable in the context of providing the service.
2. The service may be used by visitors to the website. Colourful Jobs accepts no liability whatsoever for compliance with these terms of use by other users and/or other visitors to the website.
3. The user is not permitted, without prior consent from Colourful jobs, to post job listings that recruit for multiple positions.
4. The user is not permitted to post job listing information that:
a. contains advertising messages;
b. refers to other job listings and/or information not listed on the Website;
c. is based on falsehoods and/or is misleading;
d. consists of assuming a false identity and/or wrongfully suggesting that the user is Colourful jobs with Colourful jobs ;
e. violates any applicable laws and/or regulations;
f. infringes upon the rights of Colourful jobs third parties, including but not limited to intellectual property rights or privacy rights;
g. is otherwise unlawful in any way; and/or
h. Colourful jobs harm the interests and reputation of Colourful jobs .
5. The user warrants that the job posting information they have posted does not infringe upon the (intellectual property) rights of third parties. If a user believes that certain job posting information infringes upon their (intellectual property) rights or the (intellectual property) rights of another user or a third party, the user shall immediately Colourful jobs this to Colourful jobs via the contact page on the Colourful jobs website. The user indemnifies Colourful jobs any claims for damages in that regard.
6. Colourful jobs the right to shorten, modify, or remove job posting information from the website and the service if, in Colourful jobs opinion, this is Colourful jobs , without this in any way giving rise to any right of the user to compensation and/or a refund, and/or liability on the part of Colourful jobs.
7. Colourful jobs the right to Colourful jobs the image or logo of the user’s organization provided with the job posting information within the client/assignment overview (website logo slider) as well as in the general presentation of Colourful jobs .

Article 6 Intellectual Property Rights
1. The intellectual property rights relating to the website, the service, and the content (with the exception of job posting information) are owned by Colourful jobs.
2. Users and visitors are expressly prohibited from downloading, copying, modifying, disclose, use for direct or indirect commercial purposes, or use for any purpose other than those specified in these Terms of Use, unless Colourful jobs the relevant rights holder has given permission for such use or mandatory Dutch law permits such use.

Article 7 Privacy
When submitting the registration form and using the service, the user provides information to Colourful jobs. If this information constitutes personal data, it will be stored and processed in accordance with Colourful jobs privacy statement Colourful jobs applicable laws and regulations.

Article 8 Liabilityof
1.
Colourful jobs not liable for any damage resulting from any unauthorized use of the website and/or service by third parties.
2. Colourful jobs no liability whatsoever for damage resulting from the provision of the service and the making available of the website, or from a tort or otherwise, to the extent permitted by mandatory law.
3. If, Colourful jobs the foregoing, Colourful jobs is liable to the user or visitor for damages, on whatever grounds, Colourful jobs is Colourful jobs liable for direct damages suffered by the user or visitor as a result of a failure Colourful jobs to Colourful jobs and/or tort, up to an amount not exceeding the fees that Colourful jobs received from the user or visitor Colourful jobs a period of three (3) months prior to the event giving rise to the liability. The total liability toward the user shall never exceed EUR 500 (five hundred euros).
4. Direct damage is exclusively defined as:
a. material damage to property;
b. reasonable costs incurred to prevent or limit direct damage that could be expected as a result of the event on which the liability is based; and
c. reasonable costs incurred to determine the cause of the damage.
5. Any liability of Colourful jobs damage other than direct damage, as discussed above, including in any case consequential damage, is excluded. Consequential damage includes, among other things: losses, costs incurred to prevent or determine consequential damage, loss, mix-up, or damage to electronic data, and/or damage resulting from delays in the transmission of data traffic.
6. The limitation of liability set forth in this Article does not apply in the event of intent and/or willful recklessness on the part of Colourful jobs .
7. Unless performance by Colourful jobs is Colourful jobs impossible, Colourful jobs liability Colourful jobs an attributable failure to perform the agreement arises only if the user Colourful jobs gives Colourful jobs written notice of default, setting a reasonable period for remedying the failure, and Colourful jobs continues to fail to perform its obligations in an attributable manner Colourful jobs after that period. The notice of default must contain as complete and detailed a description of the breach as possible, so that Colourful jobs is Colourful jobs opportunity Colourful jobs respond adequately.
8. There is no attributable breach of the agreement by Colourful jobs the event of force majeure. Force majeure includes, among other things: illness of employees and/or absence of staff crucial to the provision of the service, interruptions in the supply of electricity, strikes, riots, government measures, fire, natural disasters, failures of Colourful jobs suppliers, failures of third parties Colourful jobs by Colourful jobs , failures of (other) users, disruptions in the internet connection, hardware failures, disruptions in (telecommunications) networks, and other unforeseen circumstances.
9. If the force majeure continues for at least thirty (30) days, both Colourful jobs the user are entitled to terminate the agreement without being obligated to compensate for any damages arising from such termination.
10. Any claim for damages by the user or visitor that has not been specified and explicitly reported by the user or visitor shall lapse by the mere passage of twelve (12) months after the claim arose. This does not affect the user’s obligation to file a complaint.

Article 9 Term and Termination
1. The Agreement is entered into for a term of two months, unless the vacancy is filled earlier.
2. The parties have the right to terminate the agreement for the use of the service if the other party fails to fulfill its obligations under the agreement through its own fault and this party has received a proper and as detailed as possible written notice of default.
3. The services performed by Colourful jobs termination and the user’s related payment obligations shall not be subject to reversal in the event of termination.

Article 10 Miscellaneous Provisions
1. Colourful jobs the right to amend and/or supplement these Terms of Use at any time. The most current Terms of Use will be available on the website or will be brought to the user’s attention while using the service. If the user continues to use the service after these Terms of Use have been amended and/or supplemented, the user thereby irrevocably accepts the amended and/or supplemented Terms of Use. If the user does not agree to the amended and/or supplemented Terms of Use, their only option is to cease using the service.
2. Colourful jobs expressly Colourful jobs the applicability of any Terms of Use, purchasing conditions, and/or other (general) terms and conditions of the user and the visitor.
3. If these Terms of Use are or become partially invalid or are found to be partially void, the user or visitor and Colourful jobs remain bound Colourful jobs the remaining portion of these Terms of Use. Colourful jobs replace the invalid or void portion with terms that are valid and not void, and whose legal consequences, given the content and intent of these Terms of Use, correspond as closely as possible to those of the invalid and/or void portion.
